Monday, February 13, 2012 Regular & Executive Sessions:
The minutes were amended on page 3 under EDIC Working Group Update. The motion as voted was 4-0. Selectman Sherman abstained.
Motion made by Selectman Cahalane to approve the minutes of Monday, February 13, 2012 as amended.
Motion seconded by Selectman Richardson.

State Representative Randy Hunt – Information Regarding Mental Health & Substance Abuse Public Forum:
State Representative Randy Hunt announced the upcominginformational forum sponsored by the Legislature’s Joint Committee entitled; An Evening of Solutions for the Problem of Prescription Drug Abuse, an awareness event on Mental Health & Substance Abuse. The program scheduled on Monday, March 5th at 7:00 p.m. at the Sandwich High School auditorium will focus on an act relative to prescription drug diversion, abuse and addiction.
Representative Hunt indicated the Senate has passed its version of the legislation which requires doctors to participate in a statewide Prescription Monitoring Program. The database will be used to track medical professionals who over subscribe medications which often leads to curbside abuse.
Attendees of the forum will feature Sheriff Cummings who will discuss the new technique being offered at the Barnstable County Correctional facility referenced as the Vivitrol Pilot Program. Vivitrol is an alcohol and anti-addiction medication. Ray Tamasi, CEO of Gosnold of Cape Cod is expected to be in attendance with Dr. Robert Friedman.
Featured speakers also include Michael Botticelli, the Director of the Bureau of Substance Abuse Services at the MA Department of Public Health and Will Luzier, Executive Director of the Interagency Council on Substance Abuse & Prevention.
In addition to Representative Hunt who will serve as Moderator, Joint Committee members on Mental Health & Substance Abuse include John Keenan, the Senate Chair and Liz Malia, the House Chair. Lisa Murphy, the Group Leader of the Mashpee Parent’s Support Group will also be attending the forum.

Certification & Confirmation of Hiring Process – Deputy Fire Chief:
George Baker, Fire Chief was in attendance to recommend the Board approve the Hiring Certification for the position of Deputy Fire Chief. The proposed start date for the recommended candidate Thomas Rullo is March 19, 2012.
Motion made by Selectman Richardson to certify and confirm the appointment of Thomas Rullo as Deputy Fire Chief as recommended.
Motion seconded by Selectman Sherman.

Request for One Day Permit – Mashpee Wampanoag Rod & Gun Club – March 24, 2012:
Correspondence was received from Mike Hope; Secretary of the Rod & Gun Club dated February 13, 2012 requesting to use their liquor license on the date of March 24, 2012. Mr. Hope and Courtenay Mills, the former secretary was in attendance to discuss the license application with the Board of Selectmen.
Motion made by Selectman Cahalane to approve the application of the Mashpee Wampanoag Rod & Gun Club for a One Day Liquor License on March 24, 2012 as referenced, granting the license two days prior and one day after to allow for set-up and clean-up.
Motion seconded by Selectman O’Hara.

NEW BUSINESS:
Recommendation for Appointments (2) – Constables:
The Board of Selectmen reviewed the two applications received from the position of Constable. Correspondence was received from Police Chief Rodney Collins dated February 9, 2012 with respect to this regard. Chief Collins indicated that it is fair to presume that Mashpee could justify 15 constables to be consistent with the Town’s policy of one constable per thousand year-round population as determined by census. Presently, there are 8 constables in the Town of Mashpee. It was noted the two applicants reside in the Town of Mashpee.
Motion made by Selectman O’Hara to appoint Jim Irvine and Matthew Esper as Constables in the Town of Mashpee.

Request to Close for Renovations – Carbo’s Grille & Bar:
Edward Richardi remitted communication to the Selectmen dated February 21, 2012 requesting permission to close Carbo’s Grille & Bar, 681 Falmouth Road, Suite A-11 for approximately eight weeks to undergo repairs and renovations.
A representative of Carbo’s was in attendance to discuss the license application with the Board of Selectmen. For the record, there was no public comment.
Motion made by Selectman Richardson to approve the request of Carbo’s Grille & Bar to close for repairs and renovations as referenced.
Motion seconded by Selectman Cahalane.

APPOINTMENTS & HEARINGS:
Mashpee Sewer Commission:
The Board of Selectmen met with several members of the Sewer Commission including Paul Gobell, the newly appointed Sewer Administrator to review matters associated to the creation of a Water/Sewer District. It was noted the Mashpee Water District is in agreement to have water and sewer operations under one single organizational structure.
Counsel for the Water District, Attorney Henchy is expected to draft an article for the Annual Water District meeting to create a Sewer District through special legislation. Town Counsel, Patrick Costello will prepare an article for the May Town Meeting to transfer sewer operations from the Town to the Water District. A ballot questions would also be written to place the matter before the voters that would assist with the special legislation process.
Currently, the Mashpee Sewer Commission has been conducting due diligence with respect to the planning process. Several options including USGS modeling are in the development stages. The Plan when recommended by the Board of Selectmen will require approvals from MEPA and the Cape Cod Commission. It was agreed the Sewer Commission would continue their efforts to move the planning process forward to fruition as science and engineering will lead to the ultimate decision.
It was decided the Town would invite representation from the Water District to attend meetings of the Sewer Commission to collaborate resources in this effort.
It was noted there have been ongoing discussions with respect to creating a regional wastewater authority. However, the proposal is at present, a concept.
COMMUNICATIONS & CORRESPONDENCE:
May Town Meeting Warrant – Draft #1:
Draft #1 of the May Town Meeting Warrant was presented to the Board of Selectmen for review. It was agreed that a separate meeting would be held on Monday, March 5, 2012 to review the warrant.
The Board of Selectmen is scheduled to conduct a joint meeting with the Finance Committee at their regular meeting on Monday, March 12, 2012 to further review the Town Meeting warrant. It was agreed the warrant petitioners would also be invited to attend this meeting to discuss their respective petition articles.

Request for Reappointment – Barnstable County HOME Consortium:
The Board of Selectmen was in receipt of a letter of interest from Lorri Finton dated February 17, 2012 to be re-appointed as Mashpee’s representative to the Barnstable County HOME Consortium. Additional communication contained in the Selectmen’s packet included correspondence from Paul Ruchinskas of the Cape Cod Commission notifying the Town the position is due to expire at the end of January.
Motion made by Selectman Richardson to appoint Lorri Fintonto the Barnstable County HOME Consortium.
Motion seconded by Selectman Sherman.

It was agreed Ms. Finton would be invited to attend an upcoming Selectmen’s Meeting to update the Board on the Consortium.
NEW BUSINESS:
Open Meeting Law Discussion:
A brief discussion followed with respect to remote participation as it is allowed under the Open Meeting Law. It was noted that comparable Cape towns are reviewing this matter, and several towns, including Barnstable County have adopted policy with respect to this regard. Remote meeting participation is authorized by the amended Open Meeting Law regulation and is available to all municipal Board, Committees and Commissions.
It was agreed that input would be obtained from all Town Boards and Committee Chairs regarding remote participation. The matter will appear before the Selectmen at a future date to consider policy.
LIAISON REPORTS:
Budget Process: Selectman Richardson read aloud a memorandum into the record regarding the budget process, and working together in a cooperative fashion to achieve a balanced budget while maintaining the municipal services for the residents of the Town of Mashpee. (enclosed in official Town Clerk’s copy)
The Board of Selectmen commended The Town Manager and Finance Committee for the collaboration of a solid budget for the Town of Mashpee at a time of economic constraints.
EDIC: Recently, the Mashpee EDIC met with representatives from the Towns of Bourne, Sandwich and Falmouth to gain ideas for future economic development opportunities. There was a positive outcome of shared concepts and the Cape Cod Commission is interested in facilitating discussions.
